01 Overview and Acceptance of Terms

Welcome to Konkan Classic, a multiplayer online card game operated by Konkan Classic, LLC (“Company,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of the Konkan mobile application (“App”) and related services.

By downloading, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the App.

We may update these Terms from time to time. Continued use of the App after updates constitutes acceptance of the revised Terms.

02 Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the App.

By using the App, you represent and warrant that you meet this requirement.

We may request proof of age and may suspend or terminate accounts that violate this requirement.

03 Entertainment Purpose Only

The App is provided solely for entertainment purposes.

  • The App does not offer real-money gambling
  • No real-world currency can be won through gameplay
  • Virtual items, including Diamonds, have no real-world monetary value
  • Diamonds and other virtual items cannot be exchanged for cash, goods, or services outside the App

04 Accounts

To use the App, you must create an account.

You may register using:

  • Email and password
  • Apple Sign-In
  • Google Sign-In

You agree to:

  • Provide accurate and current information
  • Maintain the security of your account
  • Be responsible for all activity under your account

You may not:

  • Create multiple accounts
  • Share or transfer your account
  • Use another user’s account

05 Virtual Currency and Diamonds

The App includes a virtual currency called Diamonds.

Diamonds:

  • Are licensed, not owned
  • Have no real-world monetary value
  • Cannot be redeemed for cash
  • Cannot be sold, transferred, or exchanged outside the App

Diamonds may be used only within the App to purchase virtual goods or features, including additional Diamonds where available.

We may modify, balance, or remove Diamonds or related features at any time without liability.

06 In-App Purchases & Subscriptions

The App offers optional in-app purchases and subscriptions.

Purchases are processed exclusively through:

  • Apple App Store
  • Google Play Store

The App uses RevenueCat to manage subscription status, entitlements, and purchase validation.

We do not store full payment information.

All purchases are subject to the terms of the applicable platform.

Subscriptions may auto-renew unless canceled in your Apple or Google account settings.

07 Chargebacks and Payment Disputes

If you initiate a chargeback, payment reversal, or dispute through your payment provider:

  • We may suspend or terminate your account
  • Any associated Diamonds or virtual items may be revoked
  • We may restrict future purchases

We reserve the right to recover costs and losses resulting from fraudulent or improper chargebacks.

08 License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes.

You may not:

  • Copy, modify, or create derivative works
  • Reverse engineer or attempt to extract source code
  • Use bots, automation, or cheats
  • Exploit bugs or unintended gameplay mechanics
  • Interfere with App functionality or servers

09 User Content

You may upload limited content such as profile photos and usernames (“User Content”).

By submitting User Content, you grant Konkan Classic, LLC a:

  • Worldwide
  • Non-exclusive
  • Royalty-free
  • Fully sublicensable

license to use, store, display, reproduce, modify, and distribute such content solely to operate, improve, and promote the App.

You represent that you own or have rights to any User Content you submit.

We may remove any content at our discretion.

10 Prohibited Conduct

You agree not to:

  • Cheat, hack, or exploit the App
  • Use bots or automation
  • Harass, abuse, or threaten other users
  • Upload unlawful, offensive, or infringing content
  • Reverse engineer or modify the App
  • Interfere with servers or gameplay
  • Attempt unauthorized access to systems
  • Use the App for illegal purposes
  • Attempt to sell or transfer virtual items

We may suspend or terminate accounts for violations.

11 Player Interaction

The App does not include free-text chat, private messaging, or public forums; players cannot send custom text to one another.

The only interaction between players is a limited set of preset, non-text emotes that a player may send to an opponent during a match. These emotes are predefined by us and contain no user-written content.

We may add, change, or remove emotes at any time, and may suspend accounts that use them to harass other players (see Section 10).

12 Multiplayer Disclaimer

We do not guarantee:

  • Continuous availability
  • Error-free gameplay
  • Matchmaking availability

Service interruptions may occur.

13 Intellectual Property

All rights in the App, including software, design, graphics, branding, and content, are owned by Konkan Classic, LLC or its licensors.

You receive no ownership rights.

All rights not expressly granted are reserved.

14 Feedback License

If you provide suggestions, ideas, or feedback:

You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the App or future products without compensation or attribution.

15 Export Compliance

You agree to comply with all applicable export control and sanctions laws, including U.S. export laws.

You may not use or access the App if you are located in a restricted jurisdiction or are subject to applicable sanctions.

16 Account Termination

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • We suspect fraud or abuse
  • We are required by law
  • We discontinue the App or services

Upon termination:

  • Your license ends immediately
  • Diamonds and virtual items are forfeited
  • We have no liability to you

17 Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, including:

  • Uninterrupted operation
  • Error-free performance
  • Security or virus-free operation
  • Fitness for a particular purpose

18 Limitation of Liability

To the maximum extent permitted by law, Konkan Classic, LLC is not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or virtual items.

19 Indemnification

You agree to indemnify, defend, and hold harmless Konkan Classic, LLC and its affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your User Content

20 Dispute Resolution, Arbitration, and Class Action Waiver

Mandatory Arbitration

You agree that any dispute arising from or relating to the App or these Terms will be resolved through binding individual arbitration, not in court.

Arbitration will be administered by the American Arbitration Association (AAA) or JAMS under applicable rules.

Class Action Waiver

You agree that:

  • You may only bring claims in an individual capacity
  • You may not participate in a class action, collective action, or representative proceeding
  • The arbitrator may not consolidate claims

Exception

Either party may seek injunctive or equitable relief for intellectual property misuse.

Opt-Out

You may opt out of arbitration within 30 days of first acceptance by sending written notice to:

21 Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law principles. Any dispute, claim, or legal proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of such courts.

22 Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Konkan Classic, LLC.

23 Severability

If any provision is found unenforceable, the remaining provisions remain in full force.
